Terms of Service

These Terms of Service ("Terms") govern your use of the Family Recipe Box application and website (the "Service"), operated by Sand Point Studios LLC ("we," "us," "our"). By creating an account, tapping "I agree," or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Family Recipe Box lets you digitize, store, organize, share, and print recipes — including AI-assisted transcription of photographed recipe cards, imported web pages, and PDFs. Features vary by plan and may change over time.

2. Eligibility and accounts

• You must be at least 13 years old (or the age of digital consent in your jurisdiction).
• You sign in with a Google account. You are responsible for activity that occurs under your account and for keeping access to your sign-in method secure.
• You must provide accurate information and may not impersonate others.

3. Your content

• You retain all rights to the content you upload — recipes, photos, notes, and other material ("Your Content").
• You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and transmit Your Content solely to operate and improve the Service — including syncing it across your devices, showing it to people you explicitly share with, generating exports and printed books you request, and the AI processing described below.
• You represent that you have the necessary rights to the content you upload and that it does not infringe anyone else's rights.
• Your Content is private by default. Sharing happens only through actions you take (invitations, share links, enabling a public blog page). You can revoke shares at any time.

4. AI processing and third-party providers

• Core features of the Service transmit portions of Your Content — for example, photos of recipe cards, imported web-page text, PDFs, and meal photos — to third-party artificial-intelligence providers (currently Anthropic, PBC) to perform transcription, extraction, tagging, and description on your behalf.
• Under the API terms we operate on, this data is not used to train the provider's AI models. It is processed to deliver the feature you requested and is subject to the provider's data-handling commitments.
• AI output can be wrong. Automated transcription of handwriting is imperfect. You are responsible for reviewing extracted recipes — including quantities, temperatures, times, and ingredients — before relying on them.
• Data is also stored centrally on servers we operate (currently in the United States) so it can sync across your devices and shares. See the Privacy Policy for details.

5. Food-safety disclaimer

Recipes — whether typed, scanned, imported, or AI-transcribed — are provided for informational purposes. We do not verify the safety, accuracy, nutritional content, or allergen content of any recipe. Cooking involves inherent risks; always use your own judgment about ingredients, allergens, temperatures, and food-handling practices.

6. Plans, subscriptions, and billing

• The free plan includes limited AI-powered actions (e.g., a fixed number of card scans and web imports). Paid subscriptions ("Premium") unlock additional features and limits as described at purchase.
• Subscriptions are billed through Google Play. Prices, billing periods, and free-trial terms are shown at purchase. Subscriptions renew automatically unless cancelled in Google Play before the renewal date. Refunds are handled per Google Play policy.
• We may change pricing or plan features prospectively; changes do not affect an already-paid period.
• Fair use: "unlimited" features are subject to reasonable limits designed to prevent abuse (e.g., automated bulk scanning beyond personal use).

7. Acceptable use

You agree not to: (a) use the Service for unlawful purposes; (b) upload content that is infringing, hateful, or malicious; (c) probe, disrupt, or overload the Service; (d) attempt to access other users' data; (e) resell or scrape the Service; (f) reverse-engineer the app except where the law permits; or (g) use the Service to develop a competing dataset or service.

8. Our intellectual property

The Service — including the apps, design, logos, and software — is owned by Sand Point Studios LLC or its licensors and is protected by law. These Terms grant you a personal, non-transferable, revocable license to use the apps for their intended purpose. "Family Recipe Box" and associated marks may not be used without permission.

9. Third-party services

The Service depends on third parties (Google sign-in, Google Play billing, cloud/network infrastructure, AI providers). We are not responsible for third-party services, and their availability may affect the Service.

10. Data portability, retention, and deletion

• You can export your complete archive (structured recipes + original photos) from the app at any time.
• You may delete your account in the app or by emailing support@familyrecipebox.app; we delete associated data within 30 days, except minimal records we must keep for legal or security purposes.
• If you stop paying for Premium, Your Content remains accessible under free-plan limits — we don't hold your data hostage.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT AI-GENERATED TRANSCRIPTIONS OR DESCRIPTIONS ARE ACCURATE OR COMPLETE, OR THAT DATA WILL NEVER BE LOST — MAINTAIN YOUR OWN EXPORTS OF IRREPLACEABLE MATERIAL.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAND POINT STUDIOS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) TEN U.S. DOLLARS (US$10). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Sand Point Studios LLC and its officers, members, and agents from claims arising out of Your Content, your use of the Service, or your breach of these Terms.

14. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or create risk for us or other users; where practical we will give notice and an opportunity to export Your Content. Sections that by their nature should survive (3, 5, 8, 11–13, 15–16) survive termination.

15. Changes to these Terms

We may update these Terms. For material changes we will provide notice in the app or by email, and the updated effective date will appear above. Continued use after the effective date constitutes acceptance.

16. Governing law and disputes

These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-laws rules. Disputes shall be resolved in the state or federal courts located in Michigan, and you consent to their jurisdiction. Nothing in this section limits rights you may have under mandatory consumer-protection law in your place of residence.
